Your letter should be detailed, yet concise, and provide a clear statement explaining why the charges should be dropped or reduced.

The sample letter below concerns the following scenario: A young man (20 years old) is arrested for theft, conspiracy, and aiding and abetting. No charges are filed by the district attorney for over two years, but then notice is sent to the defendant that the DA has decided to prosecute the case. The young man's defense attorney recommends that letters of reference be sent to the DA to argue for dismissal or reduction of charges.

Dear Ms. Anderson:

It is my understanding that you are the lead prosecutor in People v. Justin Gray, a case pending in Placer County Superior Court. I am writing in support of Justin, who has been employed the last two and half years in my family's restaurant, the ******. I respectfully request that you consider reducing the charges, or even dismissing them. Justin is a fine young man who has learned from his past mistakes, has his life on track, and shows every indication of being a productive and contributing member of our community.

As background, our restaurant is a well-respected establishment in Granite Bay. We have high standards about who gets to work in our family business. I have worked here since finishing college and now oversee all aspects of the operation, including hiring and evaluating employees.

Justin was hired to bus tables but quickly moved up to a position as a waiter. I know that about nine months after he was hired he got arrested, and that charges have just been filed against him. To Justin's credit, he came to me after the arrest and told me what had happened. He said that he did something he shouldn't have and regretted it. I decided to keep him as an employee and have never regretted it.

I can honestly say that he is our hardest working and most productive employee. He has never been late and never missed an assigned shift. He willingly covers shifts for other employees when asked. He is excellent with the customers, always able to get his work done in a timely manner while being friendly and courteous.

Justin is very bright as well and I've increasingly relied on him to review our inventory and help with ordering supplies. His attention to detail is excellent and I have no doubts about his honesty.

Everything I know about Justin is that he's a person of good character. I know that he's taking courses at Sierra College and while I wish him luck with his studies, I hope that we're able to keep him with us for a number of years before he moves on. He's a valued member of our family business.

I believe that people need to be held accountable for their actions, but consider this a case of a young man who got mixed up with the wrong crowd, has learned from what he did, and sincerely regrets his actions. I encourage you to consider some alternative to the pending charges. Justin is a productive, honest member of society who will stay on the right path if you let him.
