The Legal Process

Each case is unique, but there are some aspects that all cases share as they move through the Sacramento court system. After the police make an arrest, there is an initial court appearance - called an arraignment - where a judge notifies you of the charges that are pending. If the D.A.'s office determines that sufficient evidence exists to move forward with the case, it files what is called a "complaint," a document that says that the District Attorney's office is filing charges. This is followed in the coming weeks by a pre-hearing conference, at which the defense attorney and the prosecutor review the facts of the case. It is at this point that an experienced attorney can negotiate a substantially reduced penalty or even get the case dismissed. If the case is not resolved by negotiation then it moves to the trial stage.

Sacramento County Courtroom LocationsCriminal cases in Sacramento County are heard in different facilities depending on the nature of the alleged violation. Most felony and misdemeanor cases are heard in the main courthouse on 9th Street in downtown Sacramento, while a small number are heard in the courtroom in the main jail facility on I Street. Juvenile cases take place at the Juvenile Courthouse on Kiefer Blvd. Traffic cases are handled at the Carol Miller Justice Center on Bicentennial Circle.
