Proposition 47With the passage of Proposition 47 by California voters in November 2014, the law regarding drug possession changed dramatically. Specifically, most instances of drug possession will now be classified as misdemeanors rather than felonies. This means reduced jail times and increased possibilities for access to drug treatment programs.

While drug possession for sale has been and will continue to be charged as a felony, possession for personal use will now be charged as a misdemeanor as long as the circumstances are non-serious and nonviolent. Marijuana possession will be treated as it was before with infraction charges for an ounce or less and misdemeanor charges for more than an ounce.

An important provision of Proposition 47 is the opportunity for someone currently serving time in prison for a past felony drug conviction to apply for a reduction of sentence to a misdemeanor. In addition, someone who has completed a felony drug sentence may also apply for a reduction to a misdemeanor, something that can be of great benefit when applying for a job.
